{"data":{"id":"us-ky/krs-353.6605","jurisdiction":"us-ky","citation":"KRS 353.6605","heading":"Disclosure of trade secret information to assist in responding to","body":"emergency spill or discharge.\n(1) The director shall direct a vendor, service provider, or operator, as applicable, to\nimmediately disclose information regarding the concentration or mixtu re of a\nchemical claimed to be a trade secret to the extent that the disclosure is necessary to\nassist in responding to an emergency spill or discharge, except that the individuals\nreceiving the information shall not disseminate the information further. In  addition,\nthe director upon request may disclose the specific information concerning the\nvolume of a chemical or relative concentration of chemicals, or both, which are\nclaimed to be a trade secret for the purpose of responding to an emergency spill or\ndischarge if request is made by letter or electronic mail from:\n(a) The Kentucky Department for Environmental Protection;\n(b) The Kentucky Department for Natural Resources;\n(c) The Kentucky Department for Public Health; or\n(d) A local public health department.\n(2) Any information disclosed under this section shall not be construed as publicly\navailable by virtue of the disclosure to any entity listed in this section, and release of\nthe information under this section shall not be construed as a waiver of a tra de\nsecret claim by the party who has asserted that claim.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44248","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:40Z","sha256":"93b3261c42c8405299975280cb7ab3e40658edd1bf30629ad4c98c5ce7d8d899","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.6604","next":"us-ky/krs-353.6606"},"notice":"GroundRules: Original legal text.
