{"data":{"id":"us-ky/krs-353.6606","jurisdiction":"us-ky","citation":"KRS 353.6606","heading":"Treatment of trade secret information in response to open records","body":"request.\n(1) The director shall notify the vendor, service provider, or operator, as applicable,\nwithin ten (10) days of receipt of a request pursuant to the Kentucky Open Records\nAct for disclosure of information for which trade secret status has been asserted.\nThe director may request additional information from the vendor, service provider,\nor operator, as applicable, to determine whether to grant or reject the request for\ndisclosure.\n(2) If the cabinet determines that the information is entitled to confidential treatment\nand that determination is challenged pursuant to the provisions of the Kentucky\nOpen Records Act, the director may call upon the owner or operators to assist in the\ndefense of that determination.\n(3) If the cabinet makes a determination that the information is not entitled to\nconfidential treatment, notwithstanding KRS 61.870 to 61.884, the director shall:\n(a) Notify the vendor, service provider, or operator, as applicabl e, who asserted\nthe trade secret status; and\n(b) Delay release of the information for a period of ten (10) working days after\nmailing the notice.\n(4) Judicial review of any determination under this section shall be undertaken in\naccordance with the Kentuck y Open Records Act, and administrative review of the\ndetermination to release or to withhold information shall not be required.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44249","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:40Z","sha256":"19dc67e889bdd0fb0f4d448a3447def77cf1417d1665cc40a2597668ba047da1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.6605","next":"us-ky/krs-353.670"},"notice":"GroundRules: Original legal text.
