{"data":{"id":"us-ky/krs-353.991","jurisdiction":"us-ky","citation":"KRS 353.991","heading":"Penalties for violation of KRS 353.500 to 353.720 and 353.735 to 353.747.","body":"(1) Any person who violates KRS 353.570(1) shall be subject to a civil penalty\nassessed by the cabinet of not more than one thousand dollars ($1,000), and the\ndepartment may require the proper plugging of the well. The civil penalty order may\nbe appealed pursuant to KRS 353.700 within thirty (30) days of assessment. Any\nperson who knowingly and willfully violates KRS 353.570(1) shall upon conviction\nbe guilty of a Class A misdemeanor and subject to a fine of not more than one\nthousand dollars ($1,000) or i mprisonment for a term not exceeding one hundred\nand eighty (180) days, or both.\n(2) Any person who continues to violate any provision of KRS 353.500 to 353.720 or\n353.735 to 353.747, or any regulation or order promulgated or issued under KRS\n353.500 to 35 3.720 or 353.735 to 353.747, after being notified in writing of the\nviolation by the department shall upon conviction be guilty of a Class A\nmisdemeanor and be subject to a fine of not more than one thousand dollars\n($1,000) or imprisonment for a term not exceeding one hundred and eighty (180)\ndays, or both.\n(3) Any person who does any of the following for the purpose of evading or violating\nKRS 353.500 to 353.720 or 353.735 to 353.747, or any regulation or order\npromulgated or issued under KRS 353.500 to 3 53.720 or 353.735 to 353.747, shall\nupon conviction be guilty of a Class A misdemeanor and be subject to a fine of not\nmore than one thousand dollars ($1,000) or imprisonment for a term not exceeding\none hundred and eighty (180) days, or both:\n(a) Makes or  causes to be made a false entry or statement in a report, record,\naccount or memorandum, required by KRS 353.500 to 353.720 or 353.735 to\n353.747, or by any regulation or order;\n(b) Omits or causes to be omitted from a report, record, account or memorandu m\nfull, true, and correct entries and information as required by KRS 353.500 to\n353.720 or 353.735 to 353.747, or by any regulation or order;\n(c) Removes from this Commonwealth or destroys, mutilates, alters or falsifies a\nreport, record, account or memora ndum required by KRS 353.500 to 353.720\nor 353.735 to 353.747, or by any regulation or order.\n(4) Any person who knowingly aids or abets any other person in the violation of any\nprovision of KRS 353.500 to 353.720 or 353.735 to 353.747, or any regulation o r\norder promulgated or issued under KRS 353.500 to 353.720 or 353.735 to 353.747,\nshall be subject to the same penalty as that prescribed in this section for the\nviolation by the other person.\n(5) All civil penalties recovered under this section shall be d eposited into the oil and\ngas well plugging fund established in KRS 353.590(27) and shall be for the\nplugging of any abandoned wells coming within the authority of the department\npursuant to this chapter.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48621","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:40Z","sha256":"9c18deaefea73e7aa2466e64c07f460c622dbd79fa780e701ca16e6034593690","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.990","next":"us-ky/krs-353.992"},"notice":"GroundRules: Original legal text.
