{"data":{"id":"us-ky/krs-355.12-102","jurisdiction":"us-ky","citation":"KRS 355.12-102","heading":"Definitions.","body":"(1) In this article:\n(a) 1. \"Controllable electronic record\" means a record stored in an electronic\nmedium that can be subjected to control under KRS 355.12-105.\n2. The term does not include:\na. A controllable account;\nb. A controllable payment intangible;\nc. A deposit account;\nd. An electronic copy of a record evidencing chattel paper;\ne. An electronic document of title;\nf. Electronic money;\ng. Investment property; or\nh. A transferable record;\n(b) \"Qualifying purchaser\" means a purchaser of a controllable electronic record\nor an interest in a controllable electronic record that obtains control of the\ncontrollable electronic record for value, in good faith, and without notice of a\nclaim of a property right in the controllable electronic record;\n(c) \"Transferable record\" has the meaning provided for that term in:\n1. The Electronic Signatures in Global and National Commerce Act, 15\nU.S.C. sec. 7021, as amended; or\n2. The Uniform Electronic Transactions Act, KRS 369.116; and\n(d) \"Value\" has the meaning provided in KRS 355.3 -303(1), as if references in\nthat subsection to an \"instrument\" were references to a controllable account,\ncontrollable electronic record, or controllable payment intangible.\n(2) The following definitions in Article 9 of this chapter apply to this article:\n(a) \"Account debtor\";\n(b) \"Chattel paper\";\n(c) \"Controllable account\";\n(d) \"Controllable payment intangible\";\n(e) \"Deposit account\";\n(f) \"Electronic money\"; and\n(g) \"Investment property.\"\n(3) Article 1 of this chapter contains general definitions and principles of construction\nand interpretation applicable throughout this article.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55719","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:49Z","sha256":"697ed2c9be11fb3900f863bae6973bab071651fbda66e65b6d61c9e0b6c98985","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.12-101","next":"us-ky/krs-355.12-103"},"notice":"GroundRules: Original legal text.
