{"data":{"id":"us-ky/krs-355.2-104","jurisdiction":"us-ky","citation":"KRS 355.2-104","heading":"Definitions: \"merchant\" -- \"Between merchants\" -- \"Financing agency.\"","body":"(1) \"Merchant\" means a person who deals in goods of the kind or otherwise by his\noccupation holds himself out as having knowledge or skill peculiar to the practices\nor goods involved in the transaction or to whom such knowledge or skill may be\nattributed by his employment of an agent or broker or other intermediary who by his\noccupation holds himself out as having such knowledge or skill.\n(2) \"Financing agency\" means a bank, finance company or other person who in the\nordinary course of business makes advan ces against goods or documents of title or\nwho by arrangement with either the seller or the buyer intervenes in ordinary course\nto make or collect payment due or claimed under the contract for sale, as by\npurchasing or paying the seller's draft or making a dvances against it or by merely\ntaking it for collection whether or not documents of title accompany or are\nassociated with the draft. \"Financing agency\" includes also a bank or other person\nwho similarly intervenes between persons who are in the position of seller and\nbuyer in respect to the goods (KRS 355.2-707).\n(3) \"Between merchants\" means in any transaction with respect to which both parties\nare chargeable with the knowledge or skill of merchants.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40647","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:41Z","sha256":"a5637870ae5512a10239b7f74579c75feefdedd745ef6ea537f484f956d83640","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-103","next":"us-ky/krs-355.2-105"},"notice":"GroundRules: Original legal text.
