{"data":{"id":"us-ky/krs-355.2-107","jurisdiction":"us-ky","citation":"KRS 355.2-107","heading":"Goods to be severed from realty -- Recording.","body":"(1) A contract for the sale of minerals or the like (including oil and gas) or a structure\nor its materials to be removed from realty is a contract for the sale of goods within\nthis article if they are to be severed by the seller, but until severance a purport ed\npresent sale thereof which is not effective as a transfer of an interest in land is\neffective only as a contract to sell.\n(2) A contract for the sale apart from the land of growing crops or other things attached\nto realty and capable of severance withou t material harm thereto but not described\nin subsection (1) or of timber to be cut is a contract for the sale of goods within this\narticle whether the subject matter is to be severed by the buyer or by the seller even\nthough it forms part of the realty at the time of contracting, and the parties can by\nidentification effect a present sale before severance.\n(3) The provisions of this section are subject to any third party rights provided by the\nlaw relating to realty records, and the contract for sale may be  executed and\nrecorded as a document transferring an interest in land and shall then constitute\nnotice to third parties of the buyer's rights under the contract for sale.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33250","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:41Z","sha256":"4b6b3f4e0e1b70e6e4841b17eb7f1dbfbab66ac8c7521a4d6d2d656018b801ac","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-106","next":"us-ky/krs-355.2-201"},"notice":"GroundRules: Original legal text.
