{"data":{"id":"us-ky/krs-355.2-313","jurisdiction":"us-ky","citation":"KRS 355.2-313","heading":"Express warranties by affirmation, promise, description, sample.","body":"(1) Express warranties by the seller are created as follows:\n(a) Any affirmation of fact or promise made by the seller to the buyer which\nrelates to the goods and becomes part of the basis of the bargain creates an\nexpress warranty that the goods shall conform to the affirmation or promise.\n(b) Any description of the goods which is made part of the basis of the bargain\ncreates an express warranty that the goods shall conform to the description.\n(c) Any sample or model which is made part of the basis of the b argain creates an\nexpress warranty that the whole of the goods shall conform to the sample or\nmodel.\n(2) It is not necessary to the creation of an express warranty that the seller use formal\nwords such as \"warrant\" or \"guarantee\" or that he have a specifi c intention to make\na warranty, but an affirmation merely of the value of the goods or a statement\npurporting to be merely the seller's opinion or commendation of the goods does not\ncreate a warranty.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33273","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:42Z","sha256":"a8fffec7a1063047f8933fd860c2333458c236b9192ce3fe70faedf3404d5921","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-312","next":"us-ky/krs-355.2-314"},"notice":"GroundRules: Original legal text.
