{"data":{"id":"us-ky/krs-355.2-323","jurisdiction":"us-ky","citation":"KRS 355.2-323","heading":"Form of bill of lading required in overseas shipment -- \"Overseas.\"","body":"(1) Where the contract contemplates overseas shipment and contains a term C.I.F. or C.\n\u0026 F. or F.O.B. vessel, the seller unless otherwise agreed must obtain a negotiable\nbill of lading stating that the goods have been loaded on board or, in the case of a\nterm C.I.F. or C. \u0026 F., received for shipment.\n(2) Where in a case within subsection (1) a bill of lading has been issued in a set of\nparts, unless otherwise agreed if the documents are not to be sent from abroad the\nbuyer may demand tender of the full set; ot herwise only one part of the bill of\nlading need be tendered. Even if the agreement expressly requires a full set\n(a) due tender of a single part is acceptable within the provisions of this article on\ncure of improper delivery (subsection (1) of KRS 355.2-508); and\n(b) even though the full set is demanded, if the documents are sent from abroad\nthe person tendering an incomplete set may nevertheless require payment\nupon furnishing an indemnity which the buyer in good faith deems adequate.\n(3) A shipment b y water or by air or a contract contemplating such shipment is\n\"overseas\" insofar as by usage of trade or agreement it is subject to the commercial,\nfinancing or shipping practices characteristic of international deep water commerce.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33283","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:42Z","sha256":"7adbb2bb0d073b81b710efdc80d49fa36782217284614a59ecfa967b4c06a3af","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-322","next":"us-ky/krs-355.2-324"},"notice":"GroundRules: Original legal text.
