{"data":{"id":"us-ky/krs-355.2-326","jurisdiction":"us-ky","citation":"KRS 355.2-326","heading":"Sale on approval and sale or return -- Rights of creditors.","body":"(1) Unless otherwise agreed, if delivered goods may be returned by the buyer even\nthough they conform to the contract, the transaction is:\n(a) A \"sale on approval\" if the goods are delivered primarily for use; and\n(b) A \"sale or return\" if the goods are delivered primarily for resale.\n(2) Goods held on approval are not subject to the claims of the buyer's creditors until\nacceptance; goods held on sale or return are subject to such claims while in the\nbuyer's possession.\n(3) Any \"or return\" term of a contract fo r sale is to be treated as a separate contract for\nsale within the statute of frauds section of this article (KRS 355.2 -201) and as\ncontradicting the sale aspect of the contract within the provisions of this article on\nparol or extrinsic evidence (KRS 355.2-202).","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33286","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:42Z","sha256":"165d1ad2f44147993aefef70a6dcbd7acb2e30f1366aabc4eff0f2eac44554d4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-325","next":"us-ky/krs-355.2-327"},"notice":"GroundRules: Original legal text.
