{"data":{"id":"us-ky/krs-355.2-327","jurisdiction":"us-ky","citation":"KRS 355.2-327","heading":"Special incidents of sale on approval and sale or return.","body":"(1) Under a sale on approval unless otherwise agreed\n(a) although the goods are identified to the contract the risk of loss and the title do\nnot pass to the buyer until acceptance; and\n(b) use of the goods consistent with the purpose of trial is not acceptan ce but\nfailure seasonably to notify the seller of election to return the goods is\nacceptance, and if the goods conform to the contract acceptance of any part is\nacceptance of the whole; and\n(c) after due notification of election to return, the return is a t the seller's risk and\nexpense but a merchant buyer must follow any reasonable instructions.\n(2) Under a sale or return unless otherwise agreed\n(a) the option to return extends to the whole or any commercial unit of the goods\nwhile in substantially thei r original condition, but must be exercised\nseasonably; and\n(b) the return is at the buyer's risk and expense.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33287","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:42Z","sha256":"8a3023f97fc65d28915381ce42bf13d5293e306eebb4984c0fde85f9bdeba582","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-326","next":"us-ky/krs-355.2-328"},"notice":"GroundRules: Original legal text.
