{"data":{"id":"us-ky/krs-355.2-403","jurisdiction":"us-ky","citation":"KRS 355.2-403","heading":"Power to transfer -- Good faith purchase of goods -- \"Entrusting.\"","body":"(1) A purchaser of goods acquires all title which his transferor had or had power to\ntransfer except that a purchaser of a limited interest acquires rights only to the\nextent of the interest purchased. A person with voidable title has power to transfer a\ngood title to a good faith purchaser for value. When goods have been delivered\nunder a transaction of purchase the purchaser has such power even though\n(a) the transferor was deceived as to the identity of the purchaser, or\n(b) the delivery was in exchange for a check which is later dishonored, or\n(c) it was agreed that the transaction was to be a \"cash sale,\" or\n(d) the delivery was procured through fraud punishable as larcenous under the\ncriminal law.\n(2) Any entrusting of possession of goods to a merchant who deals in goods of that kind\ngives him power to transfer all rights of the entruster to a buyer in ordinary course\nof business.\n(3) \"Entrusting\" includes any delivery and any acquiescence in retention of possession\nregardless of any condition expressed bet ween the parties to the delivery or\nacquiescence and regardless of whether the procurement of the entrusting or the\npossessor's disposition of the goods have been such as to be larcenous under the\ncriminal law.\n(4) The rights of other purchasers of goods a nd of lien creditors are governed by the\narticles on secured transactions (Article 9) and documents of title (Article 7).","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33291","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:42Z","sha256":"2f76d9cd72912cc2285dd8d80ba90bc6557cf37326a9549bd5c4f9e9a9c748ad","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-402","next":"us-ky/krs-355.2-501"},"notice":"GroundRules: Original legal text.
