{"data":{"id":"us-ky/krs-355.2-603","jurisdiction":"us-ky","citation":"KRS 355.2-603","heading":"Merchant buyer's duties as to rightfully rejected goods.","body":"(1) Subject to any security interest in the buyer (subsection (3) of KRS 355.2 -711),\nwhen the seller has no agent or place of business at the market of rejection a\nmerchant buyer is under a duty after rejection of goods in his possession or control\nto follow a ny reasonable instructions received from the seller with respect to the\ngoods and in the absence of such instructions to make reasonable efforts to sell\nthem for the seller's account if they are perishable or threaten to decline in value\nspeedily. Instructions are not reasonable if on demand indemnity for expenses is not\nforthcoming.\n(2) When the buyer sells goods under subsection (1), he is entitled to reimbursement\nfrom the seller or out of the proceeds for reasonable expenses of caring for and\nselling th em, and if the expenses include no selling commission then to such\ncommission as is usual in the trade or if there is none to a reasonable sum not\nexceeding ten percent (10%) on the gross proceeds.\n(3) In complying with this section the buyer is held only to good faith and good faith\nconduct hereunder is neither acceptance nor conversion nor the basis of an action\nfor damages.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33309","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:42Z","sha256":"39ff6128278a3e571c8a5737d50f43693ccae358c6aca0aed54d20ebca42c5be","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-602","next":"us-ky/krs-355.2-604"},"notice":"GroundRules: Original legal text.
