{"data":{"id":"us-ky/krs-355.2-609","jurisdiction":"us-ky","citation":"KRS 355.2-609","heading":"Right to adequate assurance of performance.","body":"(1) A contract for sale imposes an obligation on each party that the other's expectation\nof receiving due performance will not be impaired. When reasonable grounds for\ninsecurity arise with respect to the performance of either party the other may in\nwriting demand adequate assurance of due performance and until he receives such\nassurance may if commercially reasonable suspend any performance for which he\nhas not already received the agreed return.\n(2) Between merchants the reasonableness of grounds for insecuri ty and the adequacy\nof any assurance offered shall be determined according to commercial standards.\n(3) Acceptance of any improper delivery or payment does not prejudice the aggrieved\nparty's right to demand adequate assurance of future performance.\n(4) After receipt of a justified demand failure to provide within a reasonable time not\nexceeding thirty (30) days such assurance of due performance as is adequate under\nthe circumstances of the particular case is a repudiation of the contract.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33315","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:42Z","sha256":"52c0110e558121215135b8584a0309983e44ebeb0092b1fe928db08150fc7f29","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-608","next":"us-ky/krs-355.2-610"},"notice":"GroundRules: Original legal text.
