{"data":{"id":"us-ky/krs-355.2-612","jurisdiction":"us-ky","citation":"KRS 355.2-612","heading":"\"Installment contract\" -- Breach.","body":"(1) An \"installment contract\" is one which requires or authorizes the delivery of goods\nin separate lots to be separately accepted, even though the contract contains a clause\n\"each delivery is a separate contract\" or its equivalent.\n(2) The buyer may reject any installment which is nonconforming if the nonconformity\nsubstantially impairs the value of that installment and cannot be cured or if the\nnonconformity is a defect in the required documents; but if the nonconformity does\nnot fall within subsection (3) an d the seller gives adequate assurance of its cure the\nbuyer must accept that installment.\n(3) Whenever nonconformity or default with respect to one (1) or more installments\nsubstantially impairs the value of the whole contract there is a breach of the whol e.\nBut the aggrieved party reinstates the contract if he accepts a nonconforming\ninstallment without seasonably notifying of cancellation or if he brings an action\nwith respect only to past installments or demands performance as to future\ninstallments.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33318","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:42Z","sha256":"8c7e9a2e3c872132c2d9dcca63a40ce183a56b5bddbc2b7a4c81d9e8c88bf7f6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-611","next":"us-ky/krs-355.2-613"},"notice":"GroundRules: Original legal text.
