{"data":{"id":"us-ky/krs-355.2-702","jurisdiction":"us-ky","citation":"KRS 355.2-702","heading":"Seller's remedies on discovery of buyer's insolvency.","body":"(1) Where the seller discovers the buyer to be insolvent he may refuse delivery except\nfor cash including payment for all goods theretofore delivered under the contract,\nand stop delivery under this article (KRS 355.2-705).\n(2) Where the seller discovers that the buyer has received goods on credit while\ninsolvent he may reclaim the goods upon demand made within ten (10) days after\nthe receipt, but if misrepresentation of solvency has been made to the particular\nseller in writing within three (3) months before d elivery the ten (10) day limitation\ndoes not apply. Except as provided in this subsection the seller may not base a right\nto reclaim goods on the buyer's fraudulent or innocent misrepresentation of\nsolvency or of intent to pay.\n(3) The seller's right to reclaim under subsection (2) is subject to the rights of a buyer in\nordinary course or other good faith purchaser under this article (KRS 355.2 -403).\nSuccessful reclamation of goods excludes all other remedies with respect to them.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33324","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:42Z","sha256":"4dc3a89dc3fc045f8a3a7123e31bd0174af3fa09974ebc8f01c60c55ebf3dda7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-701","next":"us-ky/krs-355.2-703"},"notice":"GroundRules: Original legal text.
