{"data":{"id":"us-ky/krs-355.2-708","jurisdiction":"us-ky","citation":"KRS 355.2-708","heading":"Seller's damages for nonacceptance or repudiation.","body":"(1) Subject to subsection (2) and to the provisions of this article with respect to proof of\nmarket price (KRS 355.2 -723), the measure of damages for nonacceptance or\nrepudiation by the buyer is the difference between the market price at the time and\nplace for tender and the unpaid contract price together with any incidental damages\nprovided in this article (KRS 355.2-710), but less expenses saved in consequence of\nthe buyer's breach.\n(2) If the measure of damages provided in subsection (1) is inadequate to put  the seller\nin as good a position as performance would have done then the measure of damages\nis the profit (including reasonable overhead) which the seller would have made\nfrom full performance by the buyer, together with any incidental damages provided\nin this article (KRS 355.2 -710), due allowance for costs reasonably incurred and\ndue credit for payments or proceeds of resale.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33330","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:42Z","sha256":"dc76fddb0861e51d9628e1a47629782778f319a6b127f39435a38964a3afc100","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-707","next":"us-ky/krs-355.2-709"},"notice":"GroundRules: Original legal text.
