{"data":{"id":"us-ky/krs-355.2-711","jurisdiction":"us-ky","citation":"KRS 355.2-711","heading":"Buyer's remedies in general -- Buyer's security interest in rejected goods.","body":"(1) Where the seller fails to make delivery or repudiates or the buyer rightfully rejects\nor justifiably revokes acceptance then with respect to any goods involved, and with\nrespect to the whole if the breach goes to the whole contract (KRS 355.2 -612), the\nbuyer may cancel and whether or not he has done so may in addition to recovering\nso much of the price as has been paid\n(a) \"cover\" and have damages under KRS 355.2 -712 as t o all the goods affected\nwhether or not they have been identified to the contract; or\n(b) recover damages for nondelivery as provided in this article (KRS 355.2-713).\n(2) Where the seller fails to deliver or repudiates the buyer may also\n(a) if the goods have been identified recover them as provided in this article (KRS\n355.2-502); or\n(b) in a proper case obtain specific performance or replevy the goods as provided\nin this article (KRS 355.2-716).\n(3) On rightful rejection or justifiable revocation of accep tance a buyer has a security\ninterest in goods in his possession or control for any payments made on their price\nand any expenses reasonably incurred in their inspection, receipt, transportation,\ncare and custody and may hold such goods and resell them in like manner as an\naggrieved seller (KRS 355.2-706).","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33333","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:42Z","sha256":"fa864a4438f21175f34e23c5a6da9a31f64e7f87bad62cc37358e0d4442736d7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-710","next":"us-ky/krs-355.2-712"},"notice":"GroundRules: Original legal text.
