{"data":{"id":"us-ky/krs-355.2-722","jurisdiction":"us-ky","citation":"KRS 355.2-722","heading":"Who can sue third parties for injury to goods.","body":"Where a third party so deals with goods which have been identified to a contract for sale\nas to cause actionable injury to a party to that contract\n(a) a right of action against the third party is in either party to the contract for sale\nwho has title to or a security interest or a special property or an insurable\ninterest in the goods; and if the goods have been destroyed or converted a right\nof action is also in the party who either bore the risk of loss under the contract\nfor sale or has since the injury assumed that risk as against the other;\n(b) if at the time of the injury the party plaintiff did not bear the risk of loss as\nagainst the other party to the contract for sale and there is no arrangement\nbetween them for disposition of the recovery, his suit or settlement is, subject\nto his own interest, as a fiduciary for the other party to the contract;\n(c) either party may with the consent of the other sue for the benefit of whom it\nmay concern.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33344","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:42Z","sha256":"931a64184a90c3e885c6031ee945969e1a2ea2434c20130017afe930c12143fc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-721","next":"us-ky/krs-355.2-723"},"notice":"GroundRules: Original legal text.
