{"data":{"id":"us-ky/krs-355.2-725","jurisdiction":"us-ky","citation":"KRS 355.2-725","heading":"Statute of limitations in contracts for sale.","body":"(1) An action for breach of any contract for sale must be commenced within four (4)\nyears after the cause of action has accrued. By the original agreement the parties\nmay reduce the period of limitation to not less than one (1) year but may not extend\nit.\n(2) A cause of action accrues when the breach occurs, regardless of the aggrieved\nparty's lack of knowledge of the breach. A breach of warranty occurs when tender of\ndelivery is made, except that where a warranty explicitly extends to future\nperformance of the  goods and discovery of the breach must await the time of such\nperformance the cause of action accrues when the breach is or should have been\ndiscovered.\n(3) Where an action commenced within the time limited by subsection (1) is so\nterminated as to leave a vailable a remedy by another action for the same breach\nsuch other action may be commenced after the expiration of the time limited and\nwithin six (6) months after the termination of the first action unless the termination\nresulted from voluntary discontin uance or from dismissal for failure or neglect to\nprosecute.\n(4) This section does not alter the law on tolling of the statute of limitations nor does it\napply to causes of action which have accrued before this chapter becomes effective.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33347","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:42Z","sha256":"534ce12ec2e70c39dc7e12ac7c061a8f95cb4194e61f5549c5b7d812c24092d8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2-724","next":"us-ky/krs-355.2a-101"},"notice":"GroundRules: Original legal text.
