{"data":{"id":"us-ky/krs-355.2a-209","jurisdiction":"us-ky","citation":"KRS 355.2A-209","heading":"Lessee under finance lease as beneficiary of supply contract.","body":"(1) The benefit of a supplier's promises to the lessor under the supply contract and of all\nwarranties, whether express or implied, including those of any third party provided\nin connection with or as part of the supply contract, extends to the lessee to the\nextent of the lessee's leasehold interest under a finance lease related to the supply\ncontract, but is subject to the terms of the warranty and of the supply contract and\nall defenses or claims arising therefrom.\n(2) The extension of the benefit of a suppli er's promises and of warranties to the lessee\n(subsection (1) of this section) does not:\n(a) Modify the rights and obligations of the parties to the supply contract, whether\narising therefrom or otherwise, or\n(b) Impose any duty or liability under the supply contract on the lessee.\n(3) Any modification or rescission of the supply contract by the supplier and the lessor\nis effective between the supplier and the lessee unless, before the modification or\nrescission, the supplier has received notice that the le ssee has entered into a finance\nlease related to the supply contract. If the modification or rescission is effective\nbetween the supplier and the lessee, the lessor is deemed to have assumed, in\naddition to the obligations of the lessor to the lessee under  the lease contract,\npromises of the supplier to the lessor and warranties that were so modified or\nrescinded as they existed and were available to the lessee before modification or\nrescission.\n(4) In addition to the extension of the benefit of the supplie r's promises and of\nwarranties to the lessee under subsection (1), the lessee retains all rights that the\nlessee may have against the supplier which arise from an agreement between the\nlessee and the supplier or under other law.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33366","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:43Z","sha256":"622924bcecd121448534e3e2d7dca64452c815e27c6ecb9562ac64faab590ffa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2a-208","next":"us-ky/krs-355.2a-210"},"notice":"GroundRules: Original legal text.
