{"data":{"id":"us-ky/krs-355.2a-220","jurisdiction":"us-ky","citation":"KRS 355.2A-220","heading":"Effect of default on risk of loss.","body":"(1) Where risk of loss is to pass to the lessee and the time of passage is not stated:\n(a) If a tender or delivery of goods so fails to conform to the lease contract as to\ngive a right of rejection, the risk of their loss remains with the lessor, or, in the\ncase of a finance lease, the supplier, until cure or acceptance.\n(b) If the lessee rightfully revokes acceptance, he, to the extent of any deficiency\nin his effective insurance coverage, may treat the risk of loss as having\nremained with the lessor from the beginning.\n(2) Whether or not risk of loss is to pass to the lessee, if the lessee as to conforming\ngoods already identified to a lease contract repudiates or is otherwise in default\nunder the lease contract, the lessor, or, in the case of a finance lease,  the supplier, to\nthe extent of any deficiency in his effective insurance coverage may treat the risk of\nloss as resting on the lessee for a commercially reasonable time.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33377","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:43Z","sha256":"b02711e46ee54f0980c184ac85654b26d0f21442b2b98ccb36a50f7f860b1957","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2a-219","next":"us-ky/krs-355.2a-221"},"notice":"GroundRules: Original legal text.
