{"data":{"id":"us-ky/krs-355.2a-404","jurisdiction":"us-ky","citation":"KRS 355.2A-404","heading":"Substituted performance.","body":"(1) If without fault of the lessee, the lessor and the supplier, the agreed berthing,\nloading, or unloading facilities fail or the agreed type of carrier becomes unavailable\nor the agreed manner of delivery otherwise becomes commercially impracticable,\nbut a c ommercially reasonable substitute is available, the substitute performance\nmust be tendered and accepted.\n(2) If the agreed means or manner of payment fails because of domestic or foreign\ngovernmental regulation:\n(a) The lessor may withhold or stop deliver y or cause the supplier to withhold or\nstop delivery unless the lessee provides a means or manner of payment that is\ncommercially a substantial equivalent; and\n(b) If delivery has already been taken, payment by the means or in the manner\nprovided by the re gulation discharges the lessee's obligation unless the\nregulation is discriminatory, oppressive, or predatory.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33393","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:43Z","sha256":"f12d44c5bb12effc7ad2801aa4ce559cc99edcf4052b6726b7d6953bd804d53c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2a-403","next":"us-ky/krs-355.2a-405"},"notice":"GroundRules: Original legal text.
