{"data":{"id":"us-ky/krs-355.2a-501","jurisdiction":"us-ky","citation":"KRS 355.2A-501","heading":"Default procedure.","body":"(1) Whether the lessor or the lessee is in default under a lease contract is determined by\nthe lease agreement and this article.\n(2) If the lessor or the lessee is in default under the lease contract, the party seeking\nenforcement has rights and remedies as pr ovided in this article and, except as\nlimited by this article, as provided in the lease agreement.\n(3) If the lessor or the lessee is in default under the lease contract, the party seeking\nenforcement may reduce the party's claim to judgment, or otherwise enforce the\nlease contract by self -help or any available judicial procedure or nonjudicial\nprocedure, including administrative proceeding, arbitration, or the like, in\naccordance with this article.\n(4) Except as otherwise provided in KRS 355.1 -305 or this article or the lease\nagreement, the rights and remedies referred to in subsections (2) and (3) of this\nsection are cumulative.\n(5) If the lease agreement covers both real property and goods, the party seeking\nenforcement may proceed under this part as to t he goods, or under other applicable\nlaw as to both the real property and the goods in accordance with that party's rights\nand remedies in respect of the real property, in which case this part does not apply.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33397","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:43Z","sha256":"ba39ed18b25237b8fd00c150b4641927399efd74de7a13b1dcc14f3438aae3f3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.2a-407","next":"us-ky/krs-355.2a-502"},"notice":"GroundRules: Original legal text.
