{"data":{"id":"us-ky/krs-355.3-104","jurisdiction":"us-ky","citation":"KRS 355.3-104","heading":"Negotiable instrument.","body":"(1) Except as provided in subsections (3) and (4) of this section, \"negotiable\ninstrument\" means an unconditional promise or order to pay a fixed amount of\nmoney, with or without interest or other charges described in the promise or order,\nif it:\n(a) Is payabl e to bearer or to order at the time it is issued or first comes into\npossession of a holder;\n(b) Is payable on demand or at a definite time; and\n(c) Does not state any other undertaking or instruction by the person promising or\nordering payment to do any a ct in addition to the payment of money, but the\npromise or order may contain:\n1. An undertaking or power to give, maintain, or protect collateral to\nsecure payment;\n2. An authorization or power to the holder to confess judgment or realize\non or dispose of collateral;\n3. A waiver of the benefit of any law intended for the advantage or\nprotection of an obligor;\n4. A term that specifies the law that governs the promise or order; or\n5. An undertaking to resolve in a specified forum a dispute concerning the\npromise or order.\n(2) \"Instrument\" means a negotiable instrument.\n(3) An order that meets all of the requirements of subsection (1) of this section, except\nparagraph (a) of that subsection, and otherwise falls within the definition of \"check\"\nin subsection (6) of this section is a negotiable instrument and a check.\n(4) A promise or order other than a check is not an instrument if, at the time it is issued\nor first comes into possession of a holder, it contains a conspicuous statement,\nhowever expressed, to the effect that the promise or order is not negotiable or is not\nan instrument governed by this article.\n(5) (a) An instrument is a \"note\" if it is a promise and is a \"draft\" if it is an order.\n(b) If an instrument falls within the definition of both \"note\" and \"draft,\" a person\nentitled to enforce the instrument may treat it as either.\n(6) (a) \"Check\" means:\n1. A draft, other than a documentary draft, payable on demand and drawn\non a bank; or\n2. A cashier's check or teller's check.\n(b) An instrument may be a check even though it is described on its face by\nanother term, such as \"money order.\"\n(7) \"Cashier's check\" means a draft with respect to which the drawer and drawee are\nthe same bank or branches of the same bank.\n(8) \"Teller's check\" means a draft drawn by a bank:\n(a) On another bank; or\n(b) Payable at or through a bank.\n(9) \"Traveler's check\" means an instrument that:\n(a) Is payable on demand;\n(b) Is drawn on or payable at or through a bank;\n(c) Is designated by the term \"traveler's check\" or by a substantially similar term;\nand\n(d) Requires, as a condition to payment, a countersignature by a person whose\nspecimen signature appears on the instrument.\n(10) (a) \"Certificate of deposit \" means an instrument containing an acknowledgment\nby a bank that a sum of money has been received by the bank and a promise\nby the bank to repay the sum of money.\n(b) A certificate of deposit is a note of the bank.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55644","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:43Z","sha256":"9f10719acfbb9fa1d5422d06bb53c91688a0ecce22084b4c034e7098fbc14bfd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.3-103","next":"us-ky/krs-355.3-105"},"notice":"GroundRules: Original legal text.
