{"data":{"id":"us-ky/krs-355.3-501","jurisdiction":"us-ky","citation":"KRS 355.3-501","heading":"Presentment.","body":"(1) \"Presentment\" means a demand made by or on behalf of a person entitled to enforce\nan instrument:\n(a) To pay the instrument made to the drawee or a party obliged to pay the\ninstrument or, in the case of a note or accepted draft payable at a bank, to the\nbank; or\n(b) To accept a draft made to the drawee.\n(2) The following rules are subject to Article 4 of this chapter, agreement of the parties,\nand clearing-house rules and the like:\n(a) Presentment may be made at the place of payment of the instrument and mus t\nbe made at the place of payment if the instrument is payable at a bank in the\nUnited States; may be made by any commercially reasonable means, including\nan oral, written, or electronic communication; is effective when the demand\nfor payment or acceptance  is received by the person to whom presentment is\nmade; and is effective if made to any one of two (2) or more makers,\nacceptors, drawees, or other payors.\n(b) Upon demand of the person to whom presentment is made, the person making\npresentment must:\n1. Exhibit the instrument;\n2. Give reasonable identification and, if presentment is made on behalf of\nanother person, reasonable evidence of authority to do so; and\n3. Sign a receipt on the instrument for any payment made or surrender the\ninstrument if full payment is made.\n(c) Without dishonoring the instrument, the party to whom presentment is made\nmay:\n1. Return the instrument for lack of a necessary indorsement; or\n2. Refuse payment or acceptance for failure of the presentment to comply\nwith the terms of the  instrument, an agreement of the parties, or other\napplicable law or rule.\n(d) The party to whom presentment is made may treat presentment as occurring\non the next business day after the day of presentment if the party to whom\npresentment is made has established a cutoff hour not earlier than 2 p.m. for\nthe receipt and processing of instruments presented for payment or acceptance\nand presentment is made after the cutoff hour.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33491","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:44Z","sha256":"417461ab2f7cf1d0cc38fa55ab8126b41cb5f76542b55dd7531d1eb4380fa071","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.3-420","next":"us-ky/krs-355.3-502"},"notice":"GroundRules: Original legal text.
