{"data":{"id":"us-ky/krs-355.3-505","jurisdiction":"us-ky","citation":"KRS 355.3-505","heading":"Evidence of dishonor.","body":"(1) The following are admissible as evidence and create a presumption of dishonor and\nof any notice of dishonor stated:\n(a) A document regular in form as provided in subsection (2) of this section\nwhich purports to be a protest;\n(b) A purported stamp or writin g of the drawee, payor bank, or presenting bank\non or accompanying the instrument stating that acceptance or payment has\nbeen refused unless reasons for the refusal are stated and the reasons are not\nconsistent with dishonor;\n(c) A book or record of the dr awee, payor bank, or collecting bank, kept in the\nusual course of business which shows dishonor, even if there is no evidence of\nwho made the entry.\n(2) A protest is a certificate of dishonor made by a United States consul or vice consul,\nor a notary publi c or other person authorized to administer oaths by the law of the\nplace where dishonor occurs. It may be made upon information satisfactory to that\nperson. The protest must identify the instrument and certify either that presentment\nhas been made or, if n ot made, the reason why it was not made, and that the\ninstrument has been dishonored by nonacceptance or nonpayment.
