{"data":{"id":"us-ky/krs-355.3-604","jurisdiction":"us-ky","citation":"KRS 355.3-604","heading":"Discharge by cancellation or renunciation.","body":"(1) (a) A person entitled to enforce an instrument, with or without consideration, may\ndischarge the obligation of a party to pay the instrument:\n1. By an intentional voluntary act, such as surrender of the instrument to\nthe party, destruction, mutilation, or canc ellation of the instrument,\ncancellation or striking out of the party's signature, or the addition of\nwords to the instrument indicating discharge; or\n2. By agreeing not to sue or otherwise renouncing rights against the party\nby a signed record.\n(b) The obligation of a party to pay the instrument is not discharged solely by the\ndestruction of a check in connection with a process in which information is\nextracted from the check and an image of the check is made and,\nsubsequently, the information and image are transmitted for payment.\n(2) Cancellation or striking out of an indorsement pursuant to subsection (1) of this\nsection does not affect the status and rights of a party derived from the indorsement.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55648","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:44Z","sha256":"253c7c9301d46f99bef8cf1585522092429a42d8329159188039f99dc8f1122c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.3-603","next":"us-ky/krs-355.3-605"},"notice":"GroundRules: Original legal text.
