{"data":{"id":"us-ky/krs-355.4-109","jurisdiction":"us-ky","citation":"KRS 355.4-109","heading":"Delays.","body":"(1) Unless otherwise instructed, a collecting bank in a good faith effort to secure\npayment of a specific item drawn on a payor other than a bank, and with or without\nthe approval of any person involved, may waive, modify, or extend time limits\nimposed or perm itted by this chapter for a period not exceeding two (2) additional\nbanking days without discharge of drawers or indorsers or liability to its transferor\nor a prior party.\n(2) Delay by a collecting bank or payor bank beyond time limits prescribed or permitted\nby this chapter or by instructions is excused if:\n(a) The delay is caused by interruption of communication or computer facilities,\nsuspension of payments by another bank, war, emergency conditions, failure\nof equipment, or other circumstances beyond the control of the bank; and\n(b) The bank exercises such diligence as the circumstances require.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33522","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:45Z","sha256":"12b280ca6dd7d1464203197c8dae39f7fffc32cc950991f9c74d9e649f062b68","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.4-108","next":"us-ky/krs-355.4-110"},"notice":"GroundRules: Original legal text.
