{"data":{"id":"us-ky/krs-355.7-204","jurisdiction":"us-ky","citation":"KRS 355.7-204","heading":"Duty of care -- Contractual limitation of warehouse's liability.","body":"(1) A warehouse is liable for damages for loss of or injury to the goods caused by its\nfailure to exercise care with regard to the goods that a reasonably careful person\nwould exercise under similar circumstances. However, unless otherwise agreed, the\nwarehouse is not liable for damages that could not have been avoided by the\nexercise of that care.\n(2) Damages may be limited by a term in the warehouse receipt or storage agreement\nlimiting the amount of liability in case of loss or damage beyond which the\nwarehouse is not liable. Such a limitation is not effective with respect to the\nwarehouse's liability for conversion to its own use. The warehouse's liability, on\nrequest of the bailor in a record at the time of signing such storage agreement or\nwithin a reasonable time after receipt of the warehouse receipt, may be increased on\npart or all of the goods covered by the storage agreement or the warehouse receipt.\nIn this event, increased rates may be charged based on an increased valuation of the\ngoods.\n(3) Reasonable provisions as to the time and manner of presenting claims and\ncommencing actions based on the bailment may be included in the warehouse\nreceipt or storage agreement.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40611","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:46Z","sha256":"a0568be260d0fb95719932cfb26bcea08b50ecad0363566f4a877b005e6771d1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.7-203","next":"us-ky/krs-355.7-205"},"notice":"GroundRules: Original legal text.
