{"data":{"id":"us-ky/krs-355.7-302","jurisdiction":"us-ky","citation":"KRS 355.7-302","heading":"Through bills of lading and similar documents of title.","body":"(1) The issuer of a through bill of lading or other document of title embodying an\nundertaking to be performed in part by a person acting as its agent or by a\nperforming carrier is liable to any person entitled to recover on the document for\nany breach by the other person or the performing carrier of its obligation under the\ndocument. However, to the extent that the bill covers an undertaking to be\nperformed overseas or in territory not contiguous to the continental United States or\nan undertaking including mat ters other than transportation, this liability for breach\nby the other person or the performing carrier may be varied by agreement of the\nparties.\n(2) If goods covered by a through bill of lading or other document of title embodying an\nundertaking to be performed in part by a person other than the issuer are received by\nthat person, the person is subject, with respect to its own performance while the\ngoods are in its possession, to the obligation of the issuer. The person's obligation is\ndischarged by delivery of the goods to another person pursuant to the document and\ndoes not include liability for breach by any other person or by the issuer.\n(3) The issuer of a through bill of lading or other document of title described in\nsubsection (1) of this section is  entitled to recover from the performing carrier, or\nother person in possession of the goods when the breach of the obligation under the\ndocument occurred:\n(a) The amount it may be required to pay to any person entitled to recover on the\ndocument for the b reach, as may be evidenced by any receipt, judgment, or\ntranscript of judgment; and\n(b) The amount of any expense reasonably incurred by the issuer in defending any\naction commenced by any person entitled to recover on the document for the\nbreach.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40619","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:46Z","sha256":"7c6aba25291a2d35cddf9e628fc9b4ed6a205901d70978820fbb82ef42f43f2a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.7-301","next":"us-ky/krs-355.7-303"},"notice":"GroundRules: Original legal text.
