{"data":{"id":"us-ky/krs-355.7-403","jurisdiction":"us-ky","citation":"KRS 355.7-403","heading":"Obligation of bailee to deliver -- Excuse.","body":"(1) A bailee shall deliver the goods to a person entitled under a document of title if the\nperson complies with subsections (2) and (3) of this section, unless and to the extent\nthat the bailee establishes any of the following:\n(a) Delivery of the goods to a p erson whose receipt was rightful as against the\nclaimant;\n(b) Damage to or delay, loss, or destruction of the goods for which the bailee is\nnot liable;\n(c) Previous sale or other disposition of the goods in lawful enforcement of a lien\nor on a warehouse's lawful termination of storage;\n(d) The exercise by a seller of its right to stop delivery pursuant to KRS 355.2 -\n705 or by a lessor of its right to stop delivery pursuant to KRS 355.2A-526;\n(e) A diversion, reconsignment, or other disposition pursuant to KRS 355.7-303;\n(f) Release, satisfaction, or any other fact affording a personal defense against the\nclaimant; or\n(g) Any other lawful excuse.\n(2) A person claiming goods covered by a document of title shall satisfy the bailee's\nlien if the bailee so request s or the bailee is prohibited by law from delivering the\ngoods until the charges are paid.\n(3) Unless a person claiming the goods is one against which the document of title does\nnot confer a right under KRS 355.7-503(1):\n(a) The person claiming under a doc ument shall surrender possession or control\nof any outstanding negotiable document covering the goods for cancellation or\nindication of partial deliveries; and\n(b) The bailee shall cancel the document or conspicuously indicate in the\ndocument the partial delivery or be liable to any person to which the document\nis duly negotiated.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40629","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:46Z","sha256":"1bd5eee76d3f8ba884dae5cbd6a5c39030a5084f71a21ea748e5258979f325fd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.7-402","next":"us-ky/krs-355.7-404"},"notice":"GroundRules: Original legal text.
