{"data":{"id":"us-ky/krs-355.7-601","jurisdiction":"us-ky","citation":"KRS 355.7-601","heading":"Lost, stolen, or destroyed documents of title.","body":"(1) If a document of title is lost, stolen, or destroyed, a court may order delivery of the\ngoods or issuance of a substitute document and the bailee may without liability to\nany person comply with the order. If the document was negotiable, a court shall not\norder delivery of the goods or issuance of a substitute document without the\nclaimant's posting security unless it finds that any person that may suffer loss as a\nresult of nonsurrender of possession or control of the document is adequately\nprotected against the loss. If the document was nonnegotiable, the court may require\nsecurity. The court may also order payment of the bailee's reasonable costs and\nattorney's fees in any action under this subsection.\n(2) A bailee that without court order delivers goods t o a person claiming under a\nmissing negotiable document of title is liable to any person injured thereby. If the\ndelivery is not in good faith, the bailee is liable for conversion. Delivery in good\nfaith is not conversion if the claimant posts security wit h the bailee in an amount at\nleast double the value of the goods at the time of posting to indemnify any person\ninjured by the delivery which files a notice of claim within one (1) year after the\ndelivery.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40640","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:46Z","sha256":"bbe9f8f10cd7c128d2bc4acec19dfe3772d9049af07824abdab5f0765b115d06","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.7-509","next":"us-ky/krs-355.7-602"},"notice":"GroundRules: Original legal text.
