{"data":{"id":"us-ky/krs-355.8-109","jurisdiction":"us-ky","citation":"KRS 355.8-109","heading":"Warranties in indirect holding.","body":"(1) A person who originates an entitlement order to a securities intermediary warrants\nto the securities intermediary that:\n(a) The entitlement order is made by an appropriate person, or if the entitlement\norder is by an agent, the agent has actual authority t o act on behalf of the\nappropriate person; and\n(b) There is no adverse claim to the security entitlement.\n(2) A person who delivers a security certificate to a securities intermediary for credit to\na securities account or originates an instruction with res pect to an uncertificated\nsecurity directing that the uncertificated security be credited to a securities account\nmakes to the securities intermediary the warranties specified in KRS 355.8 -108(1)\nor (2).\n(3) If a securities intermediary delivers a security certificate to its entitlement holder or\ncauses its entitlement holder to be registered as the owner of an uncertificated\nsecurity, the securities intermediary makes to the entitlement holder the warranties\nspecified in KRS 355.8-108(1) or (2).","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33670","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:46Z","sha256":"ff4b904a7cc12b729d0883ffa85319adf782c164958f881544ba8f2e34d0add7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.8-108","next":"us-ky/krs-355.8-110"},"notice":"GroundRules: Original legal text.
