{"data":{"id":"us-ky/krs-355.8-112","jurisdiction":"us-ky","citation":"KRS 355.8-112","heading":"Creditor's legal process.","body":"(1) The interest of a debtor in a certificated security may be reached by a creditor only\nby actual seizure of the security certificate by the officer making the attachment or\nlevy, except as otherwise provided in subsection (4) of this section. However, a\ncertificated security for which the certificate has been surrendered to the issuer may\nbe reached by a creditor by legal process upon the issuer.\n(2) The interest of a debtor in an uncertificated security may be reached by a creditor\nonly by legal process upo n the issuer at its chief executive office in the United\nStates, except as otherwise provided in subsection (4) of this section.\n(3) The interest of a debtor in a security entitlement may be reached by a creditor only\nby legal process upon the securities i ntermediary with whom the debtor's securities\naccount is maintained, except as otherwise provided in subsection (4) of this\nsection.\n(4) The interest of a debtor in a certificated security for which the certificate is in the\npossession of a secured party, or in an uncertificated security registered in the name\nof a secured party, or a security entitlement maintained in the name of a secured\nparty, may be reached by a creditor by legal process upon the secured party.\n(5) A creditor whose debtor is the owner of a certificated security, uncertificated\nsecurity, or security entitlement is entitled to aid from a court of competent\njurisdiction, by injunction or otherwise, in reaching the certificated security,\nuncertificated security, or security entitlement or i n satisfying the claim by means\nallowed at law or in equity in regard to property that cannot readily be reached by\nother legal process.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33673","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:46Z","sha256":"faa041a14d08fff201924eb40ad708a4728da39ac2571d327250e34c155a684a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.8-111","next":"us-ky/krs-355.8-113"},"notice":"GroundRules: Original legal text.
