{"data":{"id":"us-ky/krs-355.8-114","jurisdiction":"us-ky","citation":"KRS 355.8-114","heading":"Evidentiary rules concerning certificated securities.","body":"The following rules apply in an action on a certificated security against the issuer:\n(1) Unless specifically denied in the pleadings, each signature on a security certificate\nor in a necessary indorsement is admitted.\n(2) If the effectiveness of a signatu re is put in issue, the burden of establishing\neffectiveness is on the party claiming under the signature, but the signature is\npresumed to be genuine or authorized.\n(3) If signatures on a security certificate are admitted or established, production of the\ncertificate entitles a holder to recover on it unless the defendant establishes a\ndefense or a defect going to the validity of the security.\n(4) If it is shown that a defense or defect exists, the plaintiff has the burden of\nestablishing that the plaintif f or some person under whom the plaintiff claims is a\nperson against whom the defense or defect cannot be asserted.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33675","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:46Z","sha256":"e86bb0ec552035b07482f5ffbdaaf34a694c4ce7321217b6b7a7601a13152434","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.8-113","next":"us-ky/krs-355.8-115"},"notice":"GroundRules: Original legal text.
