{"data":{"id":"us-ky/krs-355.9-304","jurisdiction":"us-ky","citation":"KRS 355.9-304","heading":"Law governing perfection and priority of security interests in deposit","body":"accounts.\n(1) The local law of a bank's jurisdiction governs perfection, the effect of perfection or\nnonperfection, and the priority of a security interest in a de posit account maintained\nwith that bank even if the transaction does not bear any relation to the bank's\njurisdiction.\n(2) The following rules determine a bank's jurisdiction for purposes of this part of this\narticle:\n(a) If an agreement between the bank a nd its customer governing the deposit\naccount expressly provides that a particular jurisdiction is the bank's\njurisdiction for purposes of this part of this article, this article, or this chapter,\nthat jurisdiction is the bank's jurisdiction;\n(b) If paragraph (a) of this subsection does not apply and an agreement between\nthe bank and its customer governing the deposit account expressly provides\nthat the agreement is governed by the law of a particular jurisdiction, that\njurisdiction is the bank's jurisdiction;\n(c) If neither paragraph (a) nor (b) of this subsection applies and an agreement\nbetween the bank and its customer governing the deposit account expressly\nprovides that the deposit account is maintained at an office in a particular\njurisdiction, that jurisdiction is the bank's jurisdiction;\n(d) If none of the preceding paragraphs applies, the bank's jurisdiction is the\njurisdiction in which the office identified in an account statement as the office\nserving the customer's account is located; and\n(e) If none of the preceding paragraphs applies, the bank's jurisdiction is the\njurisdiction in which the chief executive office of the bank is located.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55681","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:47Z","sha256":"420725e7ad8d988c8479c4fa265c8b784fccb7382e3400ff01af888eed9891e3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.9-303","next":"us-ky/krs-355.9-305"},"notice":"GroundRules: Original legal text.
