{"data":{"id":"us-ky/krs-355.9-336","jurisdiction":"us-ky","citation":"KRS 355.9-336","heading":"Commingled goods.","body":"(1) In this section, \"commingled goods\" means goods that are physically united with\nother goods in such a manner that their identity is lost in a product or mass.\n(2) A security interest does not exist in commingled goods as such. However, a security\ninterest may attach to a product or mass that results when goods become\ncommingled goods.\n(3) If collateral becomes commingled goods, a security interest attaches to the product\nor mass.\n(4) If a security interest in collateral is perfected before the collateral be comes\ncommingled goods, the security interest that attaches to the product or mass under\nsubsection (3) of this section is perfected.\n(5) Except as otherwise provided in subsection (6) of this section, the other provisions\nof this part of this article dete rmine the priority of a security interest that attaches to\nthe product or mass under subsection (3) of this section.\n(6) If more than one (1) security interest attaches to the product or mass under\nsubsection (3) of this section, the following rules determine priority:\n(a) A security interest that is perfected under subsection (4) of this section has\npriority over a security interest that is unperfected at the time the collateral\nbecomes commingled goods.\n(b) If more than one (1) security interest is perfec ted under subsection (4) of this\nsection, the security interests rank equally in proportion to the value of the\ncollateral at the time it became commingled goods.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33789","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:48Z","sha256":"73fb704d3e3a82a0001d045607aff84aec8644f3d204089add7e5dc989a2edce","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.9-335","next":"us-ky/krs-355.9-337"},"notice":"GroundRules: Original legal text.
