{"data":{"id":"us-ky/krs-355.9-405","jurisdiction":"us-ky","citation":"KRS 355.9-405","heading":"Modification of assigned contract.","body":"(1) A modification of or substitution for an assigned contract is effective against an\nassignee if made in good faith. The assignee acquires corresponding rights under the\nmodified or substituted contract. The assignment may provide that the modification\nor substitution is a breach of contract by the assignor. This subsection is subject to\nsubsections (2) to (4) of this section.\n(2) Subsection (1) of this section applies to the extent that:\n(a) The right to payment or a part thereof under an assigned contract h as not been\nfully earned by performance; or\n(b) The right to payment or a part thereof has been fully earned by performance\nand the account debtor has not received notification of the assignment under\nKRS 355.9-406(1).\n(3) This section is subject to law ot her than this article which establishes a different\nrule for an account debtor who is an individual and who incurred the obligation\nprimarily for personal, family, or household purposes.\n(4) This section does not apply to an assignment of a health-care-insurance receivable.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33801","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:48Z","sha256":"fa727993c5e590e4849db8d0bf720de93bd5c4b035c9227f1decf8cf9be070e9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.9-404","next":"us-ky/krs-355.9-406"},"notice":"GroundRules: Original legal text.
