{"data":{"id":"us-ky/krs-355.9-509","jurisdiction":"us-ky","citation":"KRS 355.9-509","heading":"Persons entitled to file a record.","body":"(1) A person may file an initial financing statement, amendment that adds collateral\ncovered by a financing statement, or amendment that adds a debtor to a financing\nstatement only if:\n(a) The debtor authorizes the filing in a signed record or pursuant to subs ection\n(2) or (3) of this section; or\n(b) The person holds an agricultural lien that has become effective at the time of\nfiling and the financing statement covers only collateral in which the person\nholds an agricultural lien.\n(2) By signing or becoming bo und as debtor by a security agreement, a debtor or new\ndebtor authorizes the filing of an initial financing statement, and an amendment,\ncovering:\n(a) The collateral described in the security agreement; and\n(b) Property that becomes collateral under KRS 35 5.9-315(1)(b), whether or not\nthe security agreement expressly covers proceeds.\n(3) By acquiring collateral in which a security interest or agricultural lien continues\nunder KRS 355.9 -315(1)(a), a debtor authorizes the filing of an initial financing\nstatement, and an amendment, covering the collateral and property that becomes\ncollateral under KRS 355.9-315(1)(b).\n(4) A person may file an amendment other than an amendment that adds collateral\ncovered by a financing statement or an amendment that adds a debt or to a financing\nstatement only if:\n(a) The secured party of record authorizes the filing; or\n(b) The amendment is a termination statement for a financing statement as to\nwhich the secured party of record has failed to file or send a termination\nstatement as required by KRS 355.9 -513(1) or (3), the debtor authorizes the\nfiling, and the termination statement indicates that the debtor authorized it to\nbe filed.\n(5) If there is more than one (1) secured party of record for a financing statement, each\nsecured party of record may authorize the filing of an amendment under subsection\n(4) of this section.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55703","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:48Z","sha256":"910c82e7190f20317eae2dda35ac9f8b41ac745f27c49da25ceb4f11c6ea86e6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.9-508","next":"us-ky/krs-355.9-510"},"notice":"GroundRules: Original legal text.
