{"data":{"id":"us-ky/krs-355.9-519","jurisdiction":"us-ky","citation":"KRS 355.9-519","heading":"Numbering, maintaining, and indexing records -- Communicating","body":"information provided in records.\n(1) For each record filed in a filing office, the filing office shall:\n(a) Assign a unique number to the filed record;\n(b) Create a record that bears the number assigned to the filed record and the date\nand time of filing;\n(c) Maintain the filed record for public inspection; and\n(d) Index the filed record in accordance with subsections (3), (4), and (5) of this\nsection.\n(2) A file number must include a digit that:\n(a) Is mathematically derived from or related to the other digits of the file\nnumber; and\n(b) Aids the filing office in determining whether a number communicated as the\nfile number includes a single-digit or transpositional error.\n(3) Except as oth erwise provided in subsections (4) and (5) of this section, the filing\noffice shall:\n(a) Index an initial financing statement according to the name of the debtor and\nindex all filed records relating to the initial financing statement in a manner\nthat assoc iates with one another an initial financing statement and all filed\nrecords relating to the initial financing statement; and\n(b) Index a record that provides a name of a debtor which was not previously\nprovided in the financing statement to which the recor d relates also according\nto the name that was not previously provided.\n(4) If a financing statement is filed as a fixture filing or covers as-extracted collateral or\ntimber to be cut, the filing office shall index it:\n(a) Under the names of the debtor and of each owner of record shown on the\nfinancing statement as if they were the mortgagors under a mortgage of the\nreal property described; and\n(b) To the extent that the law of this Commonwealth provides for indexing of\nrecords of mortgages under the name of  the mortgagee, under the name of the\nsecured party as if the secured party were the mortgagee thereunder, or, if\nindexing is by description, as if the financing statement were a record of a\nmortgage of the real property described.\n(5) If a financing statement is filed as a fixture filing or covers as-extracted collateral or\ntimber to be cut, the filing office shall index an assignment filed under KRS 355.9 -\n514(1) or an amendment filed under KRS 355.9-514(2):\n(a) Under the name of the assignor as grantor; and\n(b) To the extent that the law of this Commonwealth provides for indexing a\nrecord of the assignment of a mortgage under the name of the assignee, under\nthe name of the assignee.\n(6) The filing office shall maintain a capability:\n(a) To retrieve a record by the name of the debtor and by the file number assigned\nto the initial financing statement to which the record relates; and\n(b) To associate and retrieve with one another an initial financing statement and\neach filed record relating to the initial financing statement.\n(7) The filing office may not remove a debtor's name from the index until one (1) year\nafter the effectiveness of a financing statement naming the debtor lapses under KRS\n355.9-515 with respect to all secured parties of record.\n(8) The filing office shall perform the acts required by subsections (1) to (5) of this\nsection at the time and in the manner prescribed by filing -office rule, but not later\nthan two (2) business days after the filing office receives the record in question.\n(9) Subsection (2) of this section does not apply to a filing office described in KRS\n355.9-501(1)(a).","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33824","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:48Z","sha256":"154cd0318fd35d698e2445def04047d32eaddce521f788c60ac8c94a83c53c0c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.9-518","next":"us-ky/krs-355.9-520"},"notice":"GroundRules: Original legal text.
