{"data":{"id":"us-ky/krs-355.9-619","jurisdiction":"us-ky","citation":"KRS 355.9-619","heading":"Transfer of record or legal title.","body":"(1) In this section, \"transfer statement\" means a record signed by a secured party\nstating:\n(a) That the debtor has defaulted in connection with an obligation secured by\nspecified collateral;\n(b) That the secured party has exercised its post -default remedies w ith respect to\nthe collateral;\n(c) That, by reason of the exercise, a transferee has acquired the rights of the\ndebtor in the collateral; and\n(d) The name and mailing address of the secured party, debtor, and transferee.\n(2) (a) A transfer statement entitl es the transferee to the transfer of record of all\nrights of the debtor in the collateral specified in the statement in any official\nfiling, recording, registration, or certificate -of-title system covering the\ncollateral.\n(b) If a transfer statement is presented with the applicable fee and request form to\nthe official or office responsible for maintaining the system, the official or\noffice shall:\n1. Accept the transfer statement;\n2. Promptly amend its records to reflect the transfer; and\n3. If applicable, issue a new appropriate certificate of title in the name of\nthe transferee.\n(3) A transfer of the record or legal title to collateral to a secured party under\nsubsection (2) of this section or otherwise is not of itself a disposition of collateral\nunder this article and does not of itself relieve the secured party of its duties under\nthis article.\n(4) A secured party who complies with KRS 186.045(6) is considered to have provided\na transfer statement for purposes of this section.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55713","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:49Z","sha256":"d51248004622145df3328a9d009552eeda823063795c303c76ea2f584dcc8821","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.9-618","next":"us-ky/krs-355.9-620"},"notice":"GroundRules: Original legal text.
