{"data":{"id":"us-ky/krs-355.9-706","jurisdiction":"us-ky","citation":"KRS 355.9-706","heading":"When initial financing statement suffices to continue effectiveness of","body":"financing statement -- Minor errors or omissions.\n(1) The filing of an initial financing statement in the office specified in KRS 355.9-501,\ncontinues the effectiveness of a financing statement filed before July 1, 2001, if:\n(a) The filing of an initial financing statement in that office would be effective to\nperfect a security interest under the revision of Article 9 in 2000 Ky. Acts ch.\n408;\n(b) The pre -effective-date financing statement was filed in an office in another\nstate or another office in this Commonwealth; and\n(c) The initial financing statement satisfies subsection (3) of this section.\n(2) The filing of an initial financing statement under subsection (1) of this sectio n\ncontinues the effectiveness of the pre-effective-date financing statement:\n(a) If the initial financing statement is filed before July 1, 2001, for the period\nprovided in the former KRS 355.9 -403 with respect to a financing statement;\nand\n(b) If the initial financing statement is filed on or after July 1, 2001, for the period\nprovided in KRS 355.9-515 with respect to an initial financing statement.\n(3) To be effective for purposes of subsection (1) of this section, an initial financing\nstatement must:\n(a) Satisfy the requirements of Part 5 of this article for an initial financing\nstatement;\n(b) Identify the pre -effective-date financing statement by indicating the office in\nwhich the financing statement was filed and providing the dates of filing and\nfile n umbers, if any, of the financing statement and of the most recent\ncontinuation statement filed with respect to the financing statement; and\n(c) Indicate that the pre-effective-date financing statement remains effective.\n(4) When a secured party files an in itial financing statement with the Secretary of State\nunder subsection (1) of this section or under KRS 355.9 -707, the secured party may\nsend a copy of the initial financing statement to the county clerk of the county in\nwhich the pre -effective-date financing statement was filed, and, additionally, may\nsend to the county clerk copies of any continuation statement subsequently filed\nwith the Secretary of State that relates to an initial financing statement filed under\nsubsection (1) of this section or under KRS 355.9-707. The secured party's election\nnot to send a copy of an initial financing statement or a continuation statement to\nthe county clerk does not affect in any way the perfection of the secured party's\nsecurity interest. The county clerk shall appe nd to the pre -effective-date financing\nstatement the copy of any initial financing statement or continuation statement\nreceived from a secured party and shall retain the entire file as required by KRS\n355.9-710.\n(5) KRS 355.9-506 shall apply to determine w hether a financing statement filed under\nsubsection (1) of this section satisfies the requirements of subsection (3)(a) of this\nsection. A financing statement filed under subsection (1) of this section\nsubstantially satisfying the requirements of subsectio n (3)(b) and (c) of this section\nis effective even if it has minor errors or omissions, unless the errors or omissions\nmake the financing statement seriously misleading.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33866","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:49Z","sha256":"944d1514383c673c3199c44f62562ddd3984558af353867ad1d083c5a8557604","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.9-705","next":"us-ky/krs-355.9-707"},"notice":"GroundRules: Original legal text.
