{"data":{"id":"us-ky/krs-355.9-805","jurisdiction":"us-ky","citation":"KRS 355.9-805","heading":"Effectiveness of action taken before effective date.","body":"(1) The filing of a financing statement before July 1, 2013, is effective to perfect a\nsecurity interest to the extent the filing would satisfy the applicable requirements for\nperfection under this article, as amended by KRS 355.9-801 to 355.9-809.\n(2) KRS 355 .9-801 to 355.9 -809 do not render ineffective an effective financing\nstatement that, before July 1, 2013, is filed and satisfies the applicable requirements\nfor perfection under the law of the jurisdiction governing perfection as provided in\nthis article as it existed before July 1, 2013. However, except as otherwise provided\nin subsections (3) and (4) of this section and KRS 355.9 -806, the financing\nstatement ceases to be effective:\n(a) If the financing statement is filed in this state, at the time the fin ancing\nstatement would have ceased to be effective had this section not become law;\nor\n(b) If the financing statement is filed in another jurisdiction, at the earlier of:\n1. The time the financing statement would have ceased to be effective\nunder the law of that jurisdiction; or\n2. June 30, 2018.\n(3) The filing of a continuation statement after July 1, 2013, does not continue the\neffectiveness of the financing statement filed before July 1, 2013. However, upon\nthe timely filing of a continuation statement a fter July 1, 2013, and in accordance\nwith the law of the jurisdiction governing perfection as provided in this article, as\namended by KRS 355.9 -801 to 355.9 -809, the effectiveness of a financing\nstatement filed in the same office in that jurisdiction befor e July 1, 2013, continues\nfor the period provided by the law of that jurisdiction.\n(4) Subsection (2)(b)2. of this section applies to a financing statement that, before July\n1, 2013, is filed against a transmitting utility and satisfies the applicable\nrequirements for perfection under the law of the jurisdiction governing perfection as\nprovided in this article as it existed before July 1, 2013, only to the extent that this\narticle as amended by KRS 355.9 -801 to 355.9 -809 provides that the law of a\njurisdiction other than the jurisdiction in which the financing statement is filed\ngoverns perfection of a security interest in collateral covered by the financing\nstatement.\n(5) A financing statement that includes a financing statement filed before July 1, 2013,\nand a continuation statement filed after July 1, 2013, is effective only to the extent\nthat it satisfies the requirements of this article, as amended by KRS 355.9 -801 to\n355.9-809, for an initial financing statement. A financing statement that indicates\nthat the debtor is a decedent's estate indicates that the collateral is being\nadministered by a personal representative within the meaning of KRS 355.9 -\n503(1)(b). A financing statement that indicates that the debtor is a trust or is a\ntrustee acting with resp ect to property held in trust indicates that the collateral is\nheld in a trust within the meaning of KRS 355.9-503(1)(c).","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41130","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:49Z","sha256":"1499c60897434b98512a9624d19a449f8fe2c6708924a7a113ad37a1583edf09","source_id":"us-ky","stale":false,"prev":"us-ky/krs-355.9-804","next":"us-ky/krs-355.9-806"},"notice":"GroundRules: Original legal text.
