{"data":{"id":"us-ky/krs-36.040","jurisdiction":"us-ky","citation":"KRS 36.040","heading":"Duties of adjutant general -- Authority to enter into agreements with federal","body":"agencies.\n(1) The adjutant general shall:\n(a) Represent the Governor in all military matters pertaining to the\nCommonwealth of Kentucky;\n(b) Be the executive head of  the Department of Military Affairs and exercise all\nfunctions vested by law in the department;\n(c) Establish the internal organizational structure of the major organizations of\nthe department;\n(d) Organize and supervise all programs, functions, and person nel assigned to the\ndepartment in accordance with all state and federal statutes and administrative\nregulations;\n(e) Be responsible to the Governor for the proper carrying into effect of all laws,\nrules, and regulations of the United States and of this state affecting the militia\nand other military organizations established by law;\n(f) Perform the duties prescribed for him by laws of the United States and\nregulations issued thereunder;\n(g) Direct and supervise the chiefs of staff departments and supervise a ll troops\nand all departments, arms, and branches of the Kentucky Army and Air\nNational Guard;\n(h) Supervise the preparation of all returns and reports of the Department of\nMilitary Affairs;\n(i) Keep a register of all the officers of the Kentucky National Guard, and make a\nwritten report to the Governor for the annual period ending on June 30 of each\nyear of the operations and conditions of the Department of Military Affairs;\n(j) Cause to be prepared and issued all necessary blank books, forms, and notices\nrequired to carry into full effect matters assigned to the adjutant general under\nthe provisions of KRS Chapters 36, 37, and 38;\n(k) Direct and supervise the safekeeping and repairing of the ordnance, arms,\naccouterments, equipment, and all other military property belonging to the\nstate or issued to it by the United States;\n(l) Notify the Finance and Administration Cabinet of all military property of the\nstate which after inspection is found unsuitable for use of the cabinet;\n(m) Keep an account of:\n1. All expenses, including pay of officers and enlisted men, allowance to\nofficers and organizations;\n2. Any other moneys required to be disbursed by him and through his\noffice, including subsistence and transportation of the National Guard;\nand\n3. All military property of the United States;\n(n) Issue and make requisitions for military property under the direction of the\nGovernor, but no military property shall be issued to persons or organizations\nother than those belonging to the National Guard, except to su ch portion of\nthe Kentucky active militia as is called out by the Governor;\n(o) Maintain as a part of his office a Bureau of War Records in which all records\npertaining to wars and relics shall be kept, and be custodian of all such\nrecords, relics, colors, standards, and battle flags now the property of the state,\nor in its possession, or which the state may hereafter acquire;\n(p) Organize units of the National Guard at places designated by the Governor\nand have the members mustered into service under regul ations prescribed by\nthe Governor;\n(q) Issue all regulations, orders, and directives for the proper functioning and\nutilization of the Department of Military Affairs and its divisions;\n(r) Hire, discharge, and pay any personnel that the adjutant general de ems\nnecessary to fulfill defense contracts without regard to KRS Chapter 18A; and\n(s) Make contracts, acquire real and personal property by gift, purchase, or by\ncondemnation in the manner prescribed in the Eminent Domain Act of\nKentucky, and do all things  necessary to perform its duties under this section\nand KRS 36.080.\n(2) The adjutant general, or his or her designee, may enter into any federal contracts,\nfederal grants, and federal agreements with the United States of America, by and\nthrough the Departm ent of Defense, Department of the Army, Department of the\nAir Force, National Guard Bureau, Federal Aviation Administration, United States\nDepartment of Homeland Security, and Federal Emergency Management Agency,\nand any other division, department, or agen cy of the federal government, as may be\ndeemed necessary to carry out the general intent and purposes of the Department of\nMilitary Affairs.","path":["KRS Chapter 36"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51233","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:54Z","sha256":"74dd9ecd151255dc6e38d9ec46f3ef7d7518f10273b2c63365261c3680d54ab4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-36.030","next":"us-ky/krs-36.042"},"notice":"GroundRules: Original legal text.
