{"data":{"id":"us-ky/krs-36.450","jurisdiction":"us-ky","citation":"KRS 36.450","heading":"Automatic extension of license, permit, or certification held by members of","body":"Armed Forces deployed overseas -- Inapplicability to operator's and driver's\nlicenses, motor vehicle registrations, and licenses to carry concealed deadly\nweapon -- Renewal of concealed carry license by deployed service member.\n(1) Except as provided for in subsections (5), (6), and (7) of this section,\nnotwithstanding any other provision of law, a license, permit, or certification held\nby a member of the United States Armed For ces, including a member of the\nKentucky National Guard or Reserve on federal active duty, that expires while that\nmember is deployed overseas shall be extended until ninety (90) days after the end\nof the deployment.\n(2) The hiring, licensing, permitting, o r certifying authority shall renew a license,\npermit, or certification extended under subsection (1) of this section until the next\ndate that the license, permit, or certification expires or for the period that the\nlicense, permit, or certification is norm ally issued, at no cost to the member, if that\nmember:\n(a) Requests renewal of the license, permit, or certification within ninety (90)\ndays after the end of overseas deployment;\n(b) Provides the hiring, licensing, permitting, or certifying authority with a copy\nof the member's official orders ending the overseas deployment; and\n(c) Meets all the requirements necessary for the renewal of the license, permit, or\ncertification, except that the member need not meet the requirements, if any,\nthat relate to continuing education or training.\n(3) (a) The possession by a member specified in subsection (1) of this section of a\nlicense, permit, or certification, together with orders for overseas deployment,\nshall constitute a de facto extension of the license, permit, or certification until\nits expiration pursuant to subsection (1) of this section or until the license,\npermit, or certificate is renewed by the hiring, licensing, permitting, or\ncertifying authority, whichever occurs later.\n(b) The possession of a license , permit, or certification, together with orders for\noverseas deployment, shall constitute, during the period specified in paragraph\n(a) of this subsection, a defense to any charge for possession of an expired\nlicense, permit, or certification by the membe r specified in subsection (1) of\nthis section.\n(4) In order to avoid confusion regarding the status of a license, permit, or certification,\na service member specified in subsection (1) of this section may provide the hiring,\nlicensing, permitting, or certi fying authority a copy of the service member's\noverseas deployment orders. Upon receipt of the service member's overseas\ndeployment orders, the receiving agency shall indicate the license as extended as\nprovided in this section in the agency's records. Fai lure of a service member to\nprovide overseas deployment information to the hiring, licensing, permitting, or\ncertifying authority shall have no effect on the automatic extension of the license,\npermit, or certification or its renewal as provided in this se ction. No hiring,\nlicensing, permitting, or certifying agency shall take any adverse action with regard\nto the renewal of the license, permit, or certification of a service member who has\nbeen the subject of an overseas deployment and who has not notified the agency of\nthe overseas deployment.\n(5) This section shall not apply to a motor vehicle or motorcycle operator's license\nissued under KRS Chapter 186, a motor vehicle registration issued under KRS\nChapter 186, or a commercial driver's license issued under KRS Chapter 281A.\n(6) A license to carry a concealed deadly weapon issued pursuant to KRS 237.110 shall\nnot be extended beyond its expiration date. However, a service member specified in\nsubsection (1) of this section may:\n(a) Renew a license issued pursuant to KRS 237.110 by requesting an application\nform from the Department of Kentucky State Police by mail or facsimile, and\nreturning the completed application, photograph, and license fee to the sheriff\nprior to the expiration date of the license. The r equest for the application may\nbe submitted not more than six (6) months prior to the expiration date of the\nlicense. The Department of Kentucky State Police shall, if the applicant meets\nthe requirements of KRS 237.110, mail the new license directly to th e\napplicant at the active duty military address specified by the applicant and\nshall send notification to the sheriff who sent in the application that the license\nhas been sent directly to the applicant. No extra charges shall be made for this\nservice; or\n(b) Permit the license to expire and, upon return to the county of residence, apply\nfor renewal of the license in the same manner as if the license had been\nrenewed in a timely manner prior to its expiration without any extra fees or\npenalty charges if the  renewal is accomplished within one (1) year after the\nend of the deployment.\n(7) The Department of Kentucky State Police shall promulgate administrative\nregulations to implement the provisions of subsection (6) of this section.","path":["KRS Chapter 36"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=21484","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:55Z","sha256":"3060f95fa677ca6127cd918bb6b4c4fbfb3f669b9c04cce3fc6ff5221472df4f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-36.440","next":"us-ky/krs-36.470"},"notice":"GroundRules: Original legal text.
