{"data":{"id":"us-ky/krs-36.474","jurisdiction":"us-ky","citation":"KRS 36.474","heading":"Eligibility for funds -- Need-based applications by member's spouse or","body":"dependent for necessary expenses -- Expenditure of funds to benefit group of\nmembers, spouses, or dependents -- Expenditure of funds to Adoption\nAssistance Program applicants -- Adjutant general to award or decline --\nIdentification of other funding sources available to applicant -- Administrative\nregulations.\n(1) During active duty of a regular member of the United States Armed Forces\ndeployed outside the United States wh o names Kentucky as home of record for\nmilitary purposes or any member of a state National Guard or a Reserve component\nwho names Kentucky as home of record for military purposes, as appropriate, trust\nfund moneys shall be used to support:\n(a) The person who names Kentucky as home of record for military purposes;\n(b) The person's Kentucky resident spouse;\n(c) The person's dependent or dependents; or\n(d) A group of several members of the military or their families as described in\nparagraphs (a) to (c) of this subsection.\n(2) An application for a trust fund grant may be filed by the member who names\nKentucky as home of record for military purposes or his or her Kentucky resident\nspouse. The application shall be accompanied by an appropriate authorization to\naccess personnel information contained in the military database Defense Enrollment\nReporting System (DEERS) for verification purposes.\n(3) Subject to the availability of trust fund moneys, the adjutant general shall award a\ngrant to an applicant described in  paragraphs (a) to (c) of subsection (1) of this\nsection if that person's application is need -based, and the amount of the grant does\nnot exceed the dollar cap established by the board through the promulgation of\nadministrative regulations under KRS Chapte r 13A. An application shall be need -\nbased if:\n(a) Funds are requested for necessary expenses incurred, or to be incurred.\nNecessary expenses shall include but not be limited to:\n1. Housing;\n2. Utilities;\n3. Groceries;\n4. Health insurance copay; and\n5. Child care;\n(b) The necessary expenses created, or will create, an undue hardship on a person\nreferred to in subsection (1) of this section;\n(c) The applicant does not have reasonable access to any other funding source,\nwhether public or private; and\n(d) The military family assistance trust fund is the last resort.\n(4) Subject to the availability of trust fund moneys, the adjutant general may expend\ntrust fund money, in amounts not to exceed the dollar cap established by the b oard\nthrough the promulgation of administrative regulations under KRS Chapter 13A, to\nbenefit individuals described in subsection (1)(d) of this section if:\n(a) The individuals have a demonstrated need that affects their health, safety, or\nwell-being; and\n(b) A majority of the members of the military family assistance trust fund board\nhas approved the expenditure, verbally or in writing.\n(5) Subject to the availability of trust fund moneys, the director of the Kentucky\nNational Guard Family Services Program may expend trust fund money, in amounts\nnot to exceed the dollar cap established by the board through the promulgation of\nadministrative regulations under KRS Chapter 13A, to benefit individuals described\nin subsection (1) of this section if:\n(a) The individuals have a demonstrated need that affects their health, safety, or\nwell-being; and\n(b) A majority of the members of the military family assistance trust fund board\nhas approved the expenditure, verbally or in writing.\n(6) Subject to the availability of  military family assistance trust fund moneys, the\nadjutant general shall expend trust fund money to eligible applicants to the\nKentucky National Guard Adoption Assistance Program as provided in KRS\n36.477. Eligible applicants to the Kentucky National Guar d Adoption Assistance\nProgram shall not be subject to the requirements of subsection (1) of this section.\n(7) (a) The adjutant general shall award or decline to award a grant within sixty (60)\ndays of receiving an application.\n(b) If the adjutant general a wards or declines to award a grant, he or she shall\nstate in writing the reason for the decision and keep the writing on file.\n(c) If the adjutant general declines to award a grant, he or she shall provide the\napplicant with a copy of the writing referred to in paragraph (b) of this\nsubsection. In addition, if the adjutant general declines to award a grant due to\nthe availability of public or private funds, the adjutant general shall identify\nthe source of available funds for the applicant and provide assis tance with\nregard to seeking funds from that source.\n(8) The military family assistance trust fund board shall promulgate administrative\nregulations under KRS Chapter 13A to carry out the provisions of this section.\nThese regulations shall, at a minimum, e nhance administrative efficiency and limit\nthe dollar amount that a person may receive in grants per twelve (12) month period.","path":["KRS Chapter 36"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54488","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:55Z","sha256":"ca707183d731bb034fdf01113d7a2b1c5870b2efaa8c7131b5304a8deee4f15a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-36.472","next":"us-ky/krs-36.476"},"notice":"GroundRules: Original legal text.
