{"data":{"id":"us-ky/krs-36.477","jurisdiction":"us-ky","citation":"KRS 36.477","heading":"Kentucky National Guard Adoption Assistance Program.","body":"(1) There is hereby established the Kentucky National Guard Adoption Assistance\nProgram to be administered by the Kentucky Department of Military Affairs.\n(2) Any current or former member of the Kentucky National Guard who finalizes a\nlegal adoption procedure for the adoption of a child shall be eligible to receive\nreimbursement from the military family assistance trust fund as provided in KRS\n36.474 for actual costs associated with the adoption of the child, including a child\nwith special needs. For the purpos es of this section, a child with special needs\nmeans the same as defined in KRS 199.555(1).\n(3) The eligible current or former member of the Kentucky National Guard shall\nreceive:\n(a) Up to seven thousand dollars ($7,000) in unreimbursed direct costs relat ed to\nthe adoption of a child with special needs; or\n(b) Up to five thousand dollars ($5,000) in unreimbursed direct costs related to\nthe adoption of any other child.\n(4) Unreimbursed direct costs related to the adoption of a child with special needs or\nother child shall include:\n(a) Licensed adoption agency fees;\n(b) Legal fees;\n(c) Medical costs;\n(d) Court costs; and\n(e) Other fees or costs associated with the child adoption in accordance with state\nand federal law and after review and approval by the court at the finalization\nof the adoption.\n(5) Application for financial assistance shall be made by submitting a completed\nKentucky National Guard adoption assistance application to the adjutant general\nalong with documentary evidence of:\n(a) Finalization of the adoption; and\n(b) Certification by the secretary of the Cabinet for Health and Family Services\nthat the adopted chi ld is a child with special needs, if reimbursement for\nspecial needs adoption is sought.\n(6) If both adoptive parents are current or former members of the Kentucky National\nGuard, the application for financial assistance shall be made jointly and the amoun t\nof reimbursement shall be limited to that specified in this section.\n(7) Upon approval of the application for financial assistance, the adjutant general shall\ndispense funds from the military family assistance trust fund to the eligible\napplicant.\n(8) The Department of Military Affairs shall promulgate administrative regulations in\naccordance with KRS Chapter 13A to carry out the provisions of this section.","path":["KRS Chapter 36"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54489","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:55Z","sha256":"8940596a52960f195eb83d7cd44cdb207e839bcc02d63e0e734ce10b60a8ac36","source_id":"us-ky","stale":false,"prev":"us-ky/krs-36.476","next":"us-ky/krs-36.478"},"notice":"GroundRules: Original legal text.
