{"data":{"id":"us-ky/krs-362.1-602","jurisdiction":"us-ky","citation":"KRS 362.1-602","heading":"Partner's power to dissociate -- Wrongful dissociation.","body":"(1) A partner has the power to dissociate at any time, rightfully or wrongfully, by\nexpress will pursuant to KRS 362.1-601(1).\n(2) A partner's dissociation is wrongful only if any of the following apply:\n(a) It is in breach of an express provision of the partnership agreement; or\n(b) In the case of a partnership for a definite term or particular undertaking, before\nthe expiration of the term or the completion of the undertaking if any of the\nfollowing apply:\n1. The partner withdraws by express will, unless the withdrawal follows\nwithin ninety (90) days after another partner's dissociation by death or\notherwise under KRS 362.1 -601(6) to (10) or wrongful dissociation\nunder this subsection;\n2. The partner is expelled by judicial determination under KRS 362.1 -\n601(5);\n3. The partner is dissociated by becoming a debtor in bankruptcy; or\n4. In the case of a partner who is not an individual, trust other than a\nbusiness trust, or estate, the partner is expelled or otherwise dissociated\nbecause it willfully dissolved or terminated.\n(3) A partner who wrongfully dissociates is liable to the partnership and to the other\npartners for damages caused by the dissociation.
