{"data":{"id":"us-ky/krs-362.195","jurisdiction":"us-ky","citation":"KRS 362.195","heading":"Conveyance of real property of the partnership.","body":"(1) Where title to real property is in the partnership name, any partner may convey title\nto such property by a conveyance executed in the partnership name; but the\npartnership may recover such property unless the partner's act binds the partnership\nunder the provisions of KRS 362.190(1) or unless such property has been conveyed\nby the grantee or a person claiming through such grantee to a holder for value\nwithout knowledge that the partner, in making the conveyance, has exceeded his\nauthority.\n(2) Where title to real property is in the name of the partnership, a conveyance executed\nby a partner, in his own name, passes the equitable interest of the partnership,\nprovided the act is one within the authority of the partner under the provisions of\nKRS 362.190(1).\n(3) Where title to real property is in the name of one (1) or more but not all the partners,\nand the record does not disclose the right of the partnership, the partners in whose\nname the title stands may convey title to such property, but the partnership ma y\nrecover such property if the partners' act does not bind the partnership under the\nprovisions of KRS 362.190(1), unless the purchaser of his assignee, is a holder for\nvalue, without knowledge.\n(4) Where the title to real property is in the name of one (1 ) or more or all the partners,\nor in a third person in trust for the partnership, a conveyance executed by a partner\nin the partnership name, or in his own name, passes the equitable interest of the\npartnership, provided the act is one within the authority  of the partner under the\nprovisions of KRS 362.190(1).\n(5) Where the title to real property is in the names of all the partners a conveyance\nexecuted by all the partners passes all their rights in such property.","path":["KRS Chapter 362"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34298","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:55Z","sha256":"348e1e897ae5571eff1cd9418e8aac2f8d14886b67e6a629473bd78b26185fc3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-362.190","next":"us-ky/krs-362.2-1001"},"notice":"GroundRules: Original legal text.
