{"data":{"id":"us-ky/krs-362.2-806","jurisdiction":"us-ky","citation":"KRS 362.2-806","heading":"Known claims against dissolved limited partnership.","body":"(1) A dissolved limited partnership may dispose of the known claims against it by\nfollowing the procedure described in subsection (2) of this section.\n(2) A dissolved limited partnership may in a record notify its known claimants of the\ndissolution. The notice shall:\n(a) Specify the information required to be included in a claim;\n(b) Provide a mailing address to which the claim is to be sent;\n(c) State the deadline for receipt of the claim, which shall not be less than one\nhundred twenty (120) days after the da te the notice in a record is received by\nthe claimant;\n(d) State that the claim will be barred if not received by the deadline; and\n(e) Unless the limited partnership has been throughout its existence a limited\nliability limited partnership, state that the  barring of a claim against the\nlimited partnership will also bar any corresponding claim against any present\nor dissociated general partner which is based on KRS 362.2-404.\n(3) A claim against a dissolved limited partnership is barred if the requirements of\nsubsection (2) of this section are met and:\n(a) The claim is not received by the specified deadline; or\n(b) In the case of a claim that is timely received but rejected by the dissolved\nlimited partnership, the claimant does not commence a proceeding to enforce\nthe claim against the limited partnership within ninety (90) days after the\nreceipt of the notice of the rejection.\n(4) This section does not apply to a contingent liability or a claim based on an event\noccurring after the effective date of dissolution.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34616","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:58Z","sha256":"9af68a29479d8e4dee36ac00a41d610873ee23d49eb59fb209f25fe1f219b22b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-362.2-805","next":"us-ky/krs-362.2-807"},"notice":"GroundRules: Original legal text.
